All of the below mentioned terms and conditions apply unless a special agreement exists between KennedyFitch, the organizer of Beyond, The Global HR Leadership Forum 2016 and the Client Company/ Organization, in which case, the special agreement overrides this Agreement. If you are registering on behalf of another individual, it is your responsibility to ensure the person attending is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the attendee or participant aware of these terms and that they have accepted these terms.
All services related to Beyond, The Global HR Leadership Forum, hereinafter referred to as “the event”, are delivered by KennedyFitch, Schifflände 26,8001 Zurich, Switzerland, hereinafter referred to as “KennedyFitch”. These services are subject to the terms and conditions hereunder.
2. Acceptance of Registration and registration confirmation
Registrations become firm and irreversible upon receipt of acceptance from the Client Company of the events written Confirmation of Registration,
unless specific conditions were agreed in writing between KennedyFitch and the Client Company.
2.1 Once you have completed your registration, you will receive a confirmation by email within 2 weeks. Please ensure that your valid email is entered correctly on the registration form. Be sure to check your junk email box to in case any of your Beyond HR Forum email(s) are caught by spam filters.
2.2 You will receive essential information for registered attendees electronically at the email address and mailing address that provided on your registration form.
3. Attendee Requirements
Your registration entitles you to admittance to the Event for which you have registered. Any and all other costs associated with your attendance (including without limitation travel and accommodation expenses) shall be borne solely by you, KennedyFitch shall have no liability for such costs.
3.2 Use of Likeness.
By attending the Event you acknowledge and agree to grant KennedyFitch the right at the Event to record, film, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to KennedyFitch includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media. Delegates who do not wish to be filmed or recorded should advise the organisers by email to firstname.lastname@example.org prior to the event.
3.3 Event Content.
You acknowledge and agree that KennedyFitch, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue, and time.
All attendees must provide a form of identification: one document proving their affiliation with the company name appearing on their registration (pay stub, business card, etc.).
3.5 Attendee Badge Usage.
Attendee badges must be worn at all times in Event areas.
3.6 Visa Requirements.
It is the sole responsibility of the attendee to take care of any government visa requirements. Attendees who require an entry visa should allow sufficient time for the application procedure. Attendees should contact the nearest embassy or consulate to determine the appropriate timing of their visa applications. KennedyFitch will not contact embassies and consulates on behalf of visa applicants or provide any other assistance relating to visa issues. Failure to obtain a visa in advance of an Event does not constitute a valid basis for obtaining a refund.
4 Prohibited Conduct
4.1 Limitations on Use.
By registering for a Beyond conference pass you agree not to sell, trade, transfer, or share your complimentary code or badge.
4.2 Badge Misuse.
Attendees wearing falsified badges and/or sharing or swapping badges will be immediately ejected from the Event and banned from future Events.
4.3 Photography, Recording, Live Streaming, and Videotaping.
For promotional purposes, there may be a professional photographer and video production taking place during the conference. You are permitted to take photographs, but not to film or undertake any other recording of the event. Any filming or recording activity at an event will be deemed a breach of
copyright. You are welcome to make use of social media before, during and after an event, subject to the above.
4.4 Unethical/Non-Compliant Marketing.
KennedyFitch reserves the right to deny admission to anyone who engages in or is reputed to engage in unethical or non-compliant marketing practices.
KennedyFitch will invoice the Registration Fee sent by KennedyFitch to the Client Company. KennedyFitch will apply the VAT and/or local taxes as applicable in the country where the programme takes place. The ticket price mentioned on the website is ex. VAT.
KennedyFitch’s payment conditions are:
a) Payment date: KennedyFitch’s fees are payable 30 calendar days as of date of invoice. If the Customer confirms registration within the 30 calendar
days prior to programme delivery, payment is due before the programme on the date specified on the invoice, unless otherwise agreed in writing with the
b) Means of payment: KennedyFitch’s invoices are payable by bank transfer into one of KennedyFitch’s bank accounts – net of bank charges – or by credit
c) Queries: any query in relation to an invoice must be reported in writing to KennedyFitch within 8 calendar days after receipt of the invoice.
d) Late payment: any invoice unpaid on due date shall, immediately and without prior notice, bear an annual interest of 12% as well as a contractual indemnity for administrative costs of 15% of the remaining due amount with a minimum of 150 Euros.
6 Cancellation and Substitution
6.1 Refund requests postmarked less than sixty (60) calendar days, but prior to fourteen (14) calendar days before the start of the conference will receive a 50% refund, less a EUR 25.00 administrative fee. Refund requests postmarked within fourteen (14) calendar days of the date of the Event will not be
eligible for a refund.
6.2 All cancellations and requests for refunds MUST be submitted in writing by the deadlines listed within this policy. Telephone, fax, and e-mail requests WILL NOT be honored. Letters should be postmarked no later than sixty (60) calendar days prior to the first day of the conference to receive a full refund of the registration fee (minus an administrative fee of $25.00). 6.3 Refunds will be sent within four to six weeks after the conference has concluded.
6.4 Attendee changes or substitutions made to any attendee registration can be done until 2 days before the Event.
6.5 Once you have received your badge on site, it cannot be changed, substituted, or reissued to a different person.
6.6 Late arrivals/missed sessions
If you arrive late for an event or are absent from any session, the full ticket price remains payable.
6.7 Unforeseen circumstances
If circumstances beyond our control require us to cancel the event, you will be notified immediately. We will notify you of the new date for the event or else offer to transfer your ticket to another equivalent event. In the unlikely event of the programme being cancelled by KennedyFitch, a full refund will be made. In the event of it being found necessary, for whatever reason, that the conference is being postponed or the dates being changed, the organisers shall not be liable for any expenditure, damage or loss incurred by the delegate.
KennedyFitch owns and operates Beyond, The Global HR Leadership Forum and is committed to protecting the privacy of its attendees. KennedyFitch does not rent or sell your contact information or other personal information to a third parties. KennedyFitch is allowed to publish the name, institution, country, email and position of the participant on a list of participants for this year’s event. This list will be shared with the other attendees and this year’s sponsors.
8 Intellectual Property
8.1 All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by KennedyFitch, or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any or other trade names appearing at the Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of KennedyFitch.
8.2 For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by KennedyFitch or any of its affiliates; nor does this Agreement grant to you any right or license to
any other intellectual property rights of KennedyFitch or its affiliates, all of which shall at all times remain the exclusive property of KennedyFitch and its affiliates.
9 Disclaimer of Warranties, Limitation of Liability
9.1 KennedyFitch gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. Neither KennedyFitch nor its affiliates accept any responsibility or liability for reliance by you or any person on any aspect of the Event or any information provided at the Event.
9.2 Except as required by law, neither KennedyFitch nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.
9.3 The maximum aggregate liability of Beyond, The Global HR Leadership Forum and KennedyFitch for any claim in any way connected with, or arising from, the Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to KennedyFitch under this Agreement. Unless otherwise specifically agreed in writing with KennedyFitch, the Client Company agrees that any disputes arising between KennedyFitch and the Client Company regarding this Agreement, shall be handled in accordance with the Swiss Laws and subject to the jurisdiction of the Swiss Courts.
